Terms of Service

1. Service Agreement

SWARM ("the platform") is provided as a subscription service by the platform operator. By creating an account and subscribing to a plan, you agree to these Terms of Service in full. If you do not agree, do not use the platform.

Enterprise and Agency tiers may include custom scope, support SLAs, and negotiated terms. Standard subscriptions renew automatically unless cancelled before the renewal date.

2. Acceptable Use Policy

You are solely responsible for all content generated and actions taken through your SWARM workspace, including all connected platform accounts and API usage. You agree that you will not use SWARM to:

  • Send unsolicited bulk email, spam, or cold outreach to individuals who have not opted in to receive communications from you
  • Post promotional content on third-party platforms (Reddit, X, LinkedIn, etc.) in violation of those platforms' Terms of Service
  • Generate, publish, or distribute content that is defamatory, harassing, hateful, discriminatory, or illegal in any applicable jurisdiction
  • Create fake accounts, impersonate real people or organisations, or misrepresent the origin of content
  • Generate or distribute malware, phishing material, or other malicious content
  • Circumvent rate limits, authentication systems, or security measures on any third-party platform
  • Engage in any activity that violates Cloudflare's Acceptable Use Policy at cloudflare.com/en-gb/terms
  • Violate any applicable law, including CAN-SPAM, GDPR, CASL, or similar data protection and anti-spam legislation
  • Use the platform for any purpose related to child sexual abuse material (CSAM), terrorism, or other prohibited content categories

3. Platform Integrity & AI Disclosure

SWARM automates content creation and distribution using AI. You acknowledge that content generated by SWARM is AI-assisted. Where required by law or platform policy, you are responsible for ensuring appropriate disclosure that content is AI-generated. The platform enables AI disclosure footers by default; disabling this feature is your responsibility.

4. Content Ownership & Liability

You retain ownership of all content you provide as inputs (brand voice, topics, credentials). You acknowledge that AI-generated output may contain inaccuracies and you are responsible for reviewing content before publication. The platform operator is not liable for claims arising from content published through your account.

5. Account Suspension & Termination

The platform operator reserves the right to suspend or terminate your account at any time, with or without notice, if you violate these Terms, if required by law, or if your usage poses a risk to the platform or to third parties. No refund is owed for a suspension or termination caused by a Terms violation.

6. Data & Privacy

We collect and process data as described in our Privacy Policy. To request data deletion or export, contact privacy@swarm.dev or use the account deletion option in your dashboard settings.

7. Limitation of Liability

To the maximum extent permitted by applicable law, the platform operator's total liability for any claim arising out of or relating to the service is limited to the amount you paid in the three months preceding the claim.
